A notary public (or notary or public notary) of the common law is a public officer constituted by law to serve the public in non-contentious matters usually concerned with estates, deeds, powers-of-attorney, and foreign and international business.

A notary’s main functions are to administer oaths and affirmations, take affidavits and statutory declarations, witness and authenticate the execution of certain classes of documents, take acknowledgments of deeds and other conveyances, protest notes and bills of exchange, provide notice of foreign drafts, prepare marine or ship’s protests in cases of damage, provide exemplifications and notarial copies, and perform certain other official acts depending on the jurisdiction.

Notaries cannot give legal advice. For legal advice concerning the papers that you may be signing or for creating documents that you may need, you should consult an Attorney or qualified professional.

Document Requirements for Notary

Requirements:

State-approved ID documents fall into two groups. All acceptable ID documents must be current OR issued within the last five five year.

California-Approved ID Documents:

Group 1:

  • Id Card or driver’s license issued by the CA Dept. of Motor Vehicles

  • US Passport

  • Inmate ID Card Issued by the CA Dept.of Correction and Rehabilitation(inmate in custody in prison only)

  • Any form of inmate ID issue by a sheriff’s department (inmate in custody in a local detention facility only)

California-Approved ID Documents:

Group 2:

  • Passport issued by a foreign government

  • ID Car or driver’s license issued by another U.S. State

  • Driver’s license issued by authorized Canadian or Mexican public agency

  • U.S. military ID card (caution: some military IDs may lack all four required elements)

  • Employee ID card issued by an agency or office of the state of CA, or by an agency or office of a CA city, county, or city and county

  • Consular identification document

  • ID card issued by a federally recognized tribal government

An identification that is expired can be used only if it was issued within the last 5 years.

If you do not have a valid identification, then you can bring 2 people with you to the appointment who know you who can act as Credible Witnesses. Each of these persons must have a valid identification (unexpired ID or issued within the last 5 years) as mentioned above. Each witness must not have a financial interest in the documents being signed, and each witness must not be named in the documents being signed.

Please also be advised that I do not notarize blank documents. All documents that you present to us must have all applicable blanks filled in (this is to prevent fraud or other problems that may arise later). Note: for jurats or affidavits, you must leave the signature line blank, because the notary has to actually witness you sign the document.

I cannot give legal advice. Please consult with an attorney or qualified professional if you have any questions about the content of your documents prior to making an appointment with me.
